Terms of Service

1. Who we are and how purchases work

These Terms govern Formak, a service operated by DAIARK SL, whose registered details appear in the Legal Notice. By creating an account or using Formak, you accept these Terms.

Paddle.com Market Ltd is the Merchant of Record and authorised reseller for paid products. The payment transaction is between you and Paddle under Paddle's Buyer Terms and Refund Policy. These Terms govern your access to and use of Formak.

2. The service

Formak analyses video or images you submit and returns estimated 3D skeletons, joint angles and related metrics for sport, training and informational purposes. One credit is a prepaid entitlement to the compute required for one analysis run of up to 30 seconds. The current product, price, taxes and included features are shown on the Pricing page before checkout.

Outputs are computed estimates and may contain errors. Formak is not a medical device and does not diagnose, treat or prevent injury or disease. Do not use it for medical or safety-critical decisions; seek an appropriately qualified professional.

We may improve or change features. We will give reasonable notice where a material change adversely affects a paid entitlement.

3. Accounts

You must be at least 18, provide accurate information and keep your credentials secure. You are responsible for activity under your account. Accounts and credits may not be sold, shared or transferred.

4. Your uploads

You retain ownership of footage you submit. You grant Daiark a limited, non-exclusive licence to transmit and process it only to provide, secure and support the service as described in the Privacy Policy.

For every upload, you confirm that you hold the necessary rights and informed permission of each identifiable person shown. Where a minor appears, you must hold valid permission from their parent or legal guardian. You must not submit unlawful content or content that infringes another person's rights.

Formak does not use uploaded footage to train or improve AI models.

5. Acceptable use

You must not resell the service; use automated or bulk access except through an interface we expressly provide; reverse engineer protected elements except where law permits it; evade credits, rate limits or access controls; test or compromise security; or use Formak unlawfully or to infringe another person's rights.

6. Credits and payment

The Starter product is a one-time purchase of 10 credits. Paid credits expire six calendar months after purchase; the exact expiry date is shown in the account, and credits with the earliest expiry are used first. A credit is consumed when the requested analysis begins and compute resources are allocated to that run, whether or not the user later chooses to use or retain its output. Credits have no cash value and are non-transferable. Failed runs caused by Formak do not consume a credit or will be restored. There is currently no recurring Starter subscription. Any future subscription will be displayed with its renewal price, frequency and cancellation terms before purchase.

Paddle calculates and collects applicable taxes, provides the order confirmation and invoice, and handles payment-related requests. The checkout identifies Paddle as reseller and shows the final total before you place the order.

7. Withdrawal and refunds

EU/EEA consumers normally have 14 days to withdraw from a distance purchase, subject to the exceptions and consequences explained by Paddle at checkout and in its Refund Policy. Where withdrawal remains available after partial performance requested by the consumer, applicable law may permit a proportionate amount for analyses already supplied. Unused credits retain any mandatory withdrawal rights that apply.

Nothing in these Terms removes mandatory rights concerning faulty or non-conforming digital content or services. Eligibility and requests are explained in the Refund and Withdrawal Policy and Paddle's Refund Policy.

8. Suspension, termination and deletion

You may stop using Formak and request account deletion at privacy@formak.app. We may suspend or terminate access for a material breach, fraud, abuse, unlawful use or a security threat, normally after notice where appropriate. A refund or withdrawal may result in removal of the corresponding unused credits. Mandatory consumer remedies are unaffected.

9. Liability

Nothing excludes liability that cannot be excluded by law. For consumers, all mandatory statutory guarantees and remedies remain available. Subject to those rules, Daiark is not liable for indirect or unforeseeable loss, or for loss caused by misuse of estimated outputs. For business users only, Daiark's aggregate liability relating to Formak is limited to the amount paid for the affected product during the preceding 12 months.

10. Electronic contracting

Before purchase you can review and correct your selection in Paddle Checkout. The contract is completed when Paddle accepts the order. Paddle sends confirmation on a durable medium. Contracts are available in Spanish and English. Daiark does not separately archive a customer-accessible copy of the checkout contract; retain Paddle's confirmation. No code of conduct applies unless expressly stated.

11. Governing law, complaints and disputes

Spanish law governs these Terms. Consumers retain the mandatory protections of their country of residence and may bring proceedings in the courts provided by applicable consumer law. The EU Online Dispute Resolution platform was discontinued on 20 July 2025 and is therefore not linked here.

Send product complaints to support@formak.app and payment or withdrawal requests through Paddle Buyer Support. Consumers in Euskadi may also contact Kontsumobide or request the applicable official consumer complaint form from support@formak.app. DAIARK SL does not currently commit to consumer arbitration unless it expressly accepts a particular case.

For business users, the courts of Eibar, Gipuzkoa have exclusive jurisdiction, unless mandatory law provides otherwise.

12. Changes and contact

We may update these Terms with a new effective date. We will give reasonable advance notice of material changes affecting existing paid use. Contact: legal@formak.app.
